In the intellectual property arena, addressing infringements is an integral component to maintaining a legal basis of protection. In the case of trademarks, infringements deteriorate from the distinguishing function of the mark. Similarly, right of publicity infringements must be addressed swiftly and authoritatively. In part, dealing with infringements puts the marketplace on notice that the rights of our client are being asserted and that the name and image of that personality are not freely available for use.
